These terms govern your use of Mandaire. By using the service, you agree to these terms. If you do not agree, do not use Mandaire.

1. The Service

Mandaire is a sovereign personal context layer that connects to the digital services you authorize (email, messaging, calendar, contacts, photos, notes, docs, files, and AI conversation history) and joins them into one source-backed picture available to the AI tools and apps you already use. Mandaire is currently in private beta and available by invitation.

2. Eligibility

Account holders must be at least 18 years old. By creating an account, you represent that you meet this requirement. The service is not designed for use by children under their own accounts.

Adult account holders may include records about their own minor children in their personal Mandaire where local law permits, subject to the consents described in Section 10 of the Privacy Policy.

3. Your Account

You are responsible for maintaining the security of your account credentials and encryption keys. Mandaire cannot recover your encryption keys if they are lost. You are responsible for all activity that occurs under your account.

Ownership. You own your data. Mandaire does not claim any ownership rights over the data you provide or that is generated through your use of the service.

License. You grant Mandaire a limited license to access, process, and store your data solely for the purpose of providing the service to you. This license terminates when you close your account.

Privacy. Our handling of your data is described in our Privacy Policy, which is incorporated into these terms.

6. Connected Services

When you connect external services (email, calendar, messaging, etc.) to Mandaire, you authorize Mandaire to access those services on your behalf within the permissions you grant. You can revoke access to any connected service at any time. You remain bound by the terms of service of those external providers.

7. AI-Assisted Actions

Mandaire uses artificial intelligence to help you manage communication and commitments. While we work to make your Mandaire accurate and reliable, AI systems can make mistakes. You are responsible for reviewing actions taken by your Mandaire, particularly those that involve communication with others or financial transactions.

You can configure the level of autonomy your Mandaire has. By default, sensitive actions (sending messages, making changes to connected accounts) require your explicit approval before execution.

8. Open Source

The encryption module that handles your data is on track for release as open source with reproducible builds in Q3 2026, with an independent third-party audit on the same timeline. The schema, threat model, and architectural commitments are published today on the architecture page for review against the running system. Open-source components, when released, are governed by their respective licenses. These Terms of Service govern your use of the Mandaire service (hosted or self-hosted), not the open-source code itself.

9. Beta Service

Mandaire is currently in beta. The service may contain bugs, may be unavailable at times, and may change significantly. We provide the beta service "as is" without warranties of any kind.

10. Availability

We aim to keep Mandaire available at all times but do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

11. Limitation of Liability

To the maximum extent permitted by law, Mandaire and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the service.

Our total liability for any claim related to the service shall not exceed the amount you paid for the service in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Mandaire and its operators from third-party claims, damages, or expenses arising from: (a) your material violation of these terms, (b) your unlawful use of the service, or (c) content you instruct your Mandaire to send to others. This indemnification does not extend to claims arising from defects in the service itself, our negligence, or our breach of these terms.

13. Data-Protection Rights

Your rights under applicable data-protection law (including the EU GDPR and UK GDPR; the California CCPA / CPRA; and other state and national laws as applicable) are described in the Privacy Policy and apply regardless of these terms.

14. Termination

You may close your account at any time. We may suspend or terminate your access to the service if you violate these terms or if we determine that your use poses a risk to the service or other users. Upon termination, your data will be handled as described in our Privacy Policy.

15. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you through your Mandaire or by email. Your continued use of the service after the changes take effect constitutes your acceptance of the revised terms.

16. Governing Law

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service shall be resolved in the courts of San Francisco County, California.
